1. Introduction

These Terms & Conditions (“Terms”) govern all online orders, livestock processing requests, butcher services, scheduling, and digital interactions with Malkuch & Holloway Farm (“the Farm,” “we,” “us,” or “our”). By using our website, placing an order, or submitting processing instructions, you (“the Customer,” “Client,” or “User”) agree to these Terms for the 2026 operating year.

2. Eligibility

To use our online slaughterhouse and butcher services, Customers must:

• Be at least 18 years old.

• Provide accurate personal and contact information.

• Be legally permitted to purchase livestock or request processing services in Texas.

We reserve the right to refuse service to anyone who violates these Terms or applicable laws.

3. Livestock Ownership & Processing Requirements

Customers acknowledge that:

• All animals processed must be legally owned by the Customer or purchased directly from the Farm.

• Ownership transfers (if applicable) occur before slaughter, in compliance with Texas and federal regulations.

• Processing instructions must be submitted online before the scheduled slaughter date.

If instructions are not submitted on time, the Farm may use standard cutting specifications.

4. Regulatory Compliance

All slaughter and processing services are performed in accordance with:

• Texas state meat processing regulations

• Federal guidelines applicable to custom-exempt or inspected facilities

• Humane handling and food safety standards

Customers may not request processing that violates regulatory requirements.

5. Online Ordering, Pricing & Payment

5.1 Pricing

Prices listed online may be based on:

• Live weight

• Hanging weight

• Flat-rate processing fees

• Additional specialty services

Prices may change without notice.

5.2 Deposits & Payments

• Deposits may be required to reserve processing dates.

• Final payment is due before pickup or delivery.

• Orders will not be released until paid in full.

5.3 Refunds

Deposits and payments are generally non-refundable, except when:

• The Farm cancels the processing appointment

• An animal becomes unavailable due to circumstances beyond Customer control

Refund decisions are made at the Farm’s discretion.

6. Scheduling & Turnaround Times

• Processing dates are scheduled online and confirmed via email.

• Turnaround times vary based on workload, aging requirements, and seasonal demand.

• The Farm may reschedule appointments due to weather, equipment issues, or regulatory requirements.

Customers will be notified promptly of any changes.

7. Cut Instructions & Customization

Customers are responsible for:

• Submitting accurate and complete cutting instructions

• Reviewing available cut options before submitting

• Understanding that certain cuts may not be possible depending on carcass size or regulatory limits

If instructions are unclear, incomplete, or contradictory, the Farm may use standard cutting specifications.

8. Pickup, Delivery & Storage

8.1 Pickup

• Customers must pick up processed meat within the time frame provided.

• Unclaimed orders may incur storage fees or be disposed of after a reasonable period.

8.2 Delivery

If delivery is offered:

• Delivery fees apply

• Delivery times are estimates and may vary

8.3 Storage Responsibility

The Farm is not responsible for:

• Product quality after pickup or delivery

• Spoilage due to Customer delay or improper storage

9. Product Quality, Yield & Variability

Customers acknowledge that:

• Meat yield varies based on breed, age, diet, and cutting preferences

• The Farm cannot guarantee specific weights or quantities

• All processed products are provided “as is” within regulatory standards

No refunds are issued for natural variations in yield.

10. Liability Limitations

To the fullest extent permitted by law:

• The Farm is not liable for loss, damage, or injury resulting from the handling, storage, or consumption of processed products.

• The Farm is not responsible for Customer cooking, freezing, or storage practices.

• The Customer assumes all risks associated with consuming meat products.

Nothing in these Terms limits rights required by Texas law.

11. Online Accounts & Data Use

Customers agree to:

• Maintain accurate account information

• Keep login credentials secure

• Use the online platform responsibly

Personal information is used solely for Farm operations and is not sold or shared except as required by law.

12. Prohibited Conduct

Customers may not:

• Submit fraudulent orders

• Misrepresent animal ownership

• Abuse staff or misuse the online platform

• Request illegal processing services

Violations may result in account termination or refusal of service.

13. Changes to Terms

Malkuch & Holloway Farm may update these Terms at any time. Updated Terms apply immediately upon posting. Continued use of the online platform constitutes acceptance.
